Will I be considered as having a house or classed as a first home buyer?

Question:

I am on disability allowance and have saved money from my allowance for many years to buy a house. However, I kept most of the money at home and not in an account. Will HMRC ask for statements to see savings and/or ask about savings? If I get a personal loan from a friend, will they need to see bank account statements and a repayment plan? I do not own a house but my husband does so; will I be considered as having a house or classed as a first home buyer?

Arthur Weller replies:
HMRC should not necessarily ask for information if you buy a house literally for cash, but due to the money laundering regulations the vendor solicitor may create some obstacles for you. Also, they may only accept a transfer from a bank account in your name. If your husband already owns a residential property, then as far as the stamp duty land tax (SDLT) rules are concerned you are not a first-time buyer, and you will have to pay the extra 3% SDLT.
