HMRC Code of Practice 9 enquiries: A sad tale

Shared from Tax Insider: HMRC Code of Practice 9 enquiries: A sad tale
By Ian Roberts, August 2019

Ian Roberts takes us through a case study to show how a COP 9 investigation unfolds.

What follows is based on real code of practice 9 (COP9) cases the author has dealt with. The names and some details have been fictionalised, but the key points in this case study have occurred in real life.

The background

Jamie was ill. He had run a family Italian takeaway for many years and had done well enough to bring up his family in comfort but not luxury. However, now he had a serious medical condition and feared for how he might help provide for the family if he was unable to work.

When he found out that his condition was worsening, he took a radical step. He decided to turn off the tills in the takeaway at 7pm each night, with sales after that point being pocketed as his family nest egg.
